Terms of Service

1. Acceptance and Eligibility

By accessing and using TravoAI's services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.

You may use the Services only if you are at least 18 years old and able to form a binding contract. If you are using the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. "You" and "Customer" refer to that entity.

2. Services and Changes

TravoAI provides AI-powered real estate data and intelligence services. We will use commercially reasonable efforts to provide reliable services and technical support via email at team@travoai.com.

We may update or modify the Services from time to time, for example to improve performance, add features, or address security issues. If we make changes that materially reduce core functionality, we will notify you in advance when reasonably possible.

3. Your Responsibilities

You agree to:

• Provide accurate account information and keep your credentials secure
• Be responsible for all activity under your account
• Use the Services only for lawful purposes and in compliance with all applicable laws and regulations

You agree not to:

• Use any robot, spider, scraper, crawler, or other automated means to access the Services or extract data for any purpose
• Reverse engineer, decompile, or attempt to derive the source code or underlying models of the Services
• Copy, frame, or mirror any part of the Services other than as needed for your own internal use
• Use the Services to build or train a competing product
• Probe, scan, or test the vulnerability of any TravoAI system or network
• Use the Services in connection with any activity that is fraudulent, misleading, harassing, or discriminatory

4. Ownership and Data Rights

You own all rights, title, and interest in and to the data, documents, and other content you upload or submit to the Services ("Customer Data"). You grant TravoAI a non-exclusive, worldwide, royalty-free license to use, host, copy, process, and display Customer Data solely to provide the Services to you and to fix or improve the technical performance of the platform.

TravoAI will not share your Customer Data with other customers, nor will we use your specific real estate strategies or proprietary inputs to train models that are deployed to other customers.

TravoAI owns the Services, including all software, algorithms, models, generated reports and templates (excluding Customer Data), and all related intellectual property rights.

We may use aggregated or de-identified data derived from Customer Data to operate, analyze, and improve the Services and other offerings, provided that such data does not identify you or any individual.

5. Privacy

Our collection, use, and sharing of personal data about you and your users is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you agree that we can process your information in accordance with the Privacy Policy.

6. Payment

Access to certain features of the Services requires payment of fees as described at the time of purchase or in an order form signed by you and TravoAI ("Order"). Unless otherwise stated in an Order, fees are due at the time of purchase and are processed through our third-party payment processor.

We may change our pricing or introduce new fees by posting updated pricing or notifying you at least 7 days in advance.

7. Termination

Either party may terminate with 30 days' notice. We may terminate immediately for non-payment or breach. Upon termination, you'll have 30 days to retrieve your data before we may delete it. You remain responsible for fees through the termination date.

8. Important Disclaimers

Our data, maps, and AI-generated responses are for informational purposes only. While we source data from official GIS databases, county assessor records, and government sources, we do not guarantee 100% accuracy. You must verify all information with qualified professionals (real estate attorneys, land use consultants, surveyors, certified appraisers) before making investment or development decisions.

You understand that the Services may use AI and machine learning models and third-party data sources, and that outputs may be incomplete, incorrect, or out of date. Zoning information, parcel boundaries, and property data may not reflect recent changes or pending applications. You are solely responsible for reviewing all outputs and deciding how to use them.

Services may be temporarily unavailable for maintenance or due to circumstances beyond our control. We'll provide advance notice when possible.

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVOAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.

10. Indemnity

You agree to indemnify and hold harmless TravoAI from and against any third-party claims, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Services in violation of these Terms or applicable law.

11. General Terms

These Terms constitute the entire agreement between you and TravoAI. If any provision is found invalid, the rest remains in effect. We may assign our rights; you may not assign yours without our consent. This agreement is governed by California law, and disputes will be resolved in California courts.

12. Changes to These Terms

We may revise these Terms from time to time. If a change is material, we will provide notice, for example by email or by posting a notice on our website. The updated Terms will be effective on the date stated in the notice. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms.
